Terms of service

  1. Services:

    Our company provides a wide range of video production services, including but not limited to filming, editing, post-production, Photography and social media management. We strive to deliver high-quality services to all our clients, but we do not guarantee the outcome of any project.

  2. Payment:

    Payment for our services must be received in fulll before starting any project. We accept payment through various methods, including but not limited to bank transfer, credit card, and PayPal. In the event of late or non-payment, we reserve the right to halt work on the project and seek legal remedies.

  3. Intellectual Property:

    The video production services we provide remain the property of My Media Production until payment has been received in full. Upon receipt of payment, we grant the client a non-exclusive, non-transferable license to use the video for their own personal or commercial purposes.

  4. Confidentiality:

    We respect the confidentiality of our clients and will not disclose any information regarding their projects to any third party without their express consent.

  5. Intellectual Property:

    The video production services we provide remain the property of My Media Production until payment has been received in full. Upon receipt of payment, we grant the client a non-exclusive, non-transferable license to use the video for their own personal or commercial purposes.

    Raw footage, including but not limited to all unedited and unprocessed video and audio files, shall not be included in the final deliverables unless specifically agreed to in writing by both parties. If the client wishes to own the raw footage, they may request to purchase it from My Media Production at an additional cost.

  6. Warranty and Liability:

    Our company provides our services on an “as is” and “as available” basis. We do not warrant that our services will meet your expectations or that they will be error-free. We shall not be liable for any damages arising from the use of our services, including but not limited to indirect, incidental, or consequential damages.

  7. Cancellation:

    In the event of cancellation, My Media Production will provide the client with a minimum notice period. This notice period may vary depending on the circumstances and will be agreed upon in advance by both parties. If My Media Production receives another offer or opportunity during this notice period, it reserves the right to cancel without penalty or issue. If the notice period has elapsed, and the client cannot reschedule or make alternative arrangements, My Media Production is obligated to fulfil its duties as outlined in the agreement.

  8. Travel:

    Travel expense is to be paid outside of a 15-mile radius from the Studio location CM21 0EP at £0.45p. My Media Production will advise the client on this prior to carrying out the task. Other expenses, such as parking costs and train fares, will also be charged to the client with prior notice from My Media Production if applicable.

  9. Equipment:

    My Media Production will provide all necessary equipment owned by My Media Production at no additional cost to the client to carry out the project. However, if the client requires specific equipment not owned by My Media Production, rental fees will be applicable and agreed upon in advance by both parties.

  10. Turnaround time:

    My Media Production will advise the client on an estimated turnaround time for content. This is subject to workload and requirements.

  11. Actors/ Talent:

    Talent is to be supplied by the client or provided by My Media Production at an additional fee. My Media Production will advise the client on the said fee before making the required booking.

  12. Music Licensing:

    My Media Production will provide the client with royalty-free music for the videos outlined in this agreement. Additional licensing fees may be applicable if the client requires a specific song or licence, additional licensing fees may be applicable.

  13. Post-Production:

    Colour grading, editing, audio correction and export is included at no extra charge.

  14. Pre-planning:

    The client will provide My Media Production with a clear outline of the content they wish to produce for a given day/ project. The client will provide as much detail as possible to ensure a clear understanding of the task

    given.

  15. Amendments:

    The allocated amount of amendments offered by My Media Production for each video is limited to two sets per video. If the client wishes to make amendments following the production of the video, they must provide My Media Production with a written description of the changes, including as much detail as possible. Two sets of changes are equivalent to two detailed emails. Given their expertise, My Media Production will advise the client accordingly on the feasibility of the requested changes. Any additional amendments beyond the allocated set may be subject to an hourly charge of £45/per hour.

  16. Back Up:

    My Media Production will provide an onsite backup for a minimum period of 6 months. We advise the client to provide an external Hard drive that My Media Production can make a second backup, and the client can keep it. The client’s backup will only include finished videos and no project files. The Client must not under any circumstance edit, re-edit or post video clips created by My Media Production without first notifying My Media Production – This contract is for produced video content outlined above and not unlimited RAW clip usage.

  17. Usage:

    The client may use the produced videos provided by My Media Production in any way that is not harming either party.

  18. Health & Safety:

    My Media Production & the client will act according to all relevant health and safety requirements to provide the product(s) or service(s).

  19. Creative Brief:

    The client accepts My Media Production decisions on creativity within the product(s) or service(s) and understands that ideas previously agreed upon may not be possible thereafter. My Media Production will inform and advise the client on any changes if deemed necessary.

  20. Liability:

    My Media Production accepts no liability for any loss or damage that may arise from the supply of the product(s) or service(s). My Media Production also accepts no liability for media corruption but ensues all measures are taken to limit this possibility.

  21. Copyright:

    My Media Production retains copyright in all their Original Material. The client must also ensure that permission is sought for the inclusion of any performers or performances, trademarks, locations and music. My Media Production retains the right to use this material in its original and edited form that is not damaging to either party as they see fit unless otherwise agreed in writing. The client agrees to indemnify My Media Production in case of any breach of copyright claims being brought against them regarding material supplied by the client.

  22. Data Protection:

    The client must ensure that all necessary arrangements have been made with, and permissions obtained from, people and places that may be recorded on video as a result of My Media Production supplying the product(s) or service(s) – and that such recording is in compliance with Data Protection. My Media Production reserves the right to use extracts from the finished production for publicity purposes on the My Media Production website and any social media. The client will notify those attending the event that they may be recorded on video cameras and that by attendance, they give their consent to being recorded.

  23. GDPR:

    The client will adhere to any laws in relation to Data protection and GDPR. They will seek permission from any persons featured in recordings/photographs and agrees to indemnify My Media Production in the event of any breach or claims being brought against them with regard to the services outlined and provided by My Media Production.

  24. Confidentiality

    My Media Production will treat any information gained during the supply of the product(s) or service(s) as being private and confidential. Likewise, the client shall keep confidential any methodologies and technology used by My Media Production to supply the product(s) or service(s).

  25. It is agreed that at the time of renegotiation for a subsequent contract, the client will automatically invite My Media Production to renegotiate the agreement before any other third party.

  26. In the event of a dispute arising that the parties themselves cannot resolve, the Parties agree to refer the matter to an independent arbitrator appointed by mutual agreement. If the parties cannot agree on an arbitrator, or both parties do not agree with the decision of the arbitrator appointed, the agreement may be terminated in the following manner:

    a) If the breach is one that can be rectified, then the non-breaching party can request in writing that the breach be rectified in 14 days. If the breach is not rectified within that time, the non-breaching party may terminate the Agreement immediately.

    b) If the breach is one that cannot be rectified, the non-breaching party may terminate the Agreement by giving 14 days' written notice of their intention to terminate.

    c) If either party goes into liquidation, is wound up, dissolved (except for the purpose of reconstruction or amalgamation), enters into a scheme of arrangement or is placed under official management or in receivership, the other party may terminate the Agreement by giving 14 days written notice of their intention to terminate under the clause.

    d) in the event of termination under this Agreement, each party’s rights and liabilities will cease immediately, but the termination shall not affect a party’s rights arising out of a breach of this agreement by the other party.

    e) If the terms of this agreement have not been breached and section 21. c) does not apply, and the client wishes to terminate the contract early. Any outstanding payments subject to this contract will be issued by My Media Production.

  27. Termination:

    Either party may terminate these Terms at any time by providing written notice to the other party. All rights granted to the client under these Terms shall immediately cease upon termination.

  28. VAT:

    Please note that My Media Production is currently not registered for Value Added Tax (VAT). However, if My Media Production becomes VAT registered in the future, any prices listed on the website or in marketing materials may be subject to additional VAT costs, which are not included in the price advertised.

  29. Governing Law:

    These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which My Media Production is located.

  30. Entire:

    Agreement These Terms constitute the entire agreement between the parties and supersede all prior agreements, understandings, and negotiations, whether written or oral, relating to the subject matter of these Terms.
